The testimonies reported clearly indicate that the Syrian regime, through
its war plans which are the only capable of flying the area, has targeted
civilian buildings, and civilian persons in various locations of Darya, by
use of what appears to be metal cooking gas tanks converted into bombs and
filled with incendiary substances. The testimonies that the VDC was able to
gather clearly indicate that the fatalities were particularly affected by
various degrees of burns.

The execution of indiscriminate attacks on civilians, and using incendiary
weapons capable by design to cause superfluous injuries and unnecessary
suffering constitute each on its own a serious violation of international
humanitarian law. They accordingly constitute war crimes.

Furthermore, those attacks are part of a pattern in which regime forces have
deliberately and systematically targeted civilians, engaged in
indiscriminate attacks, against many Eastern and Western Ghouta localities,
including Darya, which is under siege by the regime for more than two years.
The regime’s use of incendiary weapons, which are designed to cause
unnecessary suffering, makes these attacks elements in a crime against
humanity as defined in Article 7 of the Rome Statute of the International
Criminal Court, and in customary international humanitarian law.

On August 7, 2015, the United Nations Security Council voted Resolution
2235, purporting to establish an OPCW-United Nations Joint Investigative
Mechanism to identify perpetrators, organisers, and sponsors involved in the
use of chemicals as weapons, including chlorine in Syria. In a clear message
of defiance, the Syrian regime continues unabated to deliberately target
civilians by use of a large variety of prohibited weapons, including
incendiary weapons, as documented in Darya on August 11, 2015. The regime
does so, because of a deep sense that despite this modest action of the
international community, it will nevertheless get away with total impunity.
This impunity must stop. The international community must send a clear
message by creating effective and credible accountability mechanisms to
judge and punish all perpetrators of war crimes and crimes against humanity
in Syria.

تبين الشهادات بوضوح أن النظام السوري، بطيارنه الذي يحلق وحيداً في منطقة
داريا، قد استهدف المباني المدنية والمدنيين. في أماكن متفرقة من داريا، وذلك
بالقاء اسطوانات تشبه اسطوانات الغار المنزلي التي تم تحويلها إلى قنابل وحشوها
بمواد محرقة. تبين جميع الشهادات التي تمكن مركز توثيق الانتهاكات من جمعها بأن
كافة الإصابات قد تأثرت بحروق على درجات متفاوته.

إن تنفيذ الهجمات العشوائية على المدنيين، واستخدام الأسلحة المحرقة التي تسبب
إصابات زائدة ومعاناة غير ضرورية تشكل، كل بحد ذاتها، انتهاكا جسيماً للقانون
الإنساني الدولي، وفقا للقانون الإنساني الدولي العرفي. وهذا بدوره يشكل جريمة
حرب.

وعلاوة على ذلك، فإن هذه الهجمات هي جزء من النمط الذي اتبعته قوات النظام،
عمداً وبشكل ممنهج، في استهداف المدنيين واللجوء إلى الهجمات العشوائية ضد
العديد من مدن الغوطتين الغربية والشرقية، بما في ذلك داريا، والتي ترزح تحت
الحصار منذ سنتين. إن استخدام النظام للأسلحة المحرقة التي تم تصميمها لتتسبب
في معاناة لا داعي لها، يجعل من هذه الهجمات جريمة ضد الإنسانية كما تم تعريفها
في المادة 7 من نظام روما الأساسي للمحكمة الجنائية الدولية، وفي القانون
الدولي العرفي.

بتاريخ 7 آب/أغسطس 2015 أصدر مجلس الأمن التابع للأمم المتحددة قراره رقم 2235
أنشأ بموجبه آلية تحقيق مشتركة بين منظمة حظر الأسلحة الكيماوية والأمم المتحدة
لتحديد المرتكبين والمنظمين والممولين في استخدام المواد الكيماوية كأسلحة في
سورية، بما في ذلك غاز الكلور. ولكن في رسالة تحدي واضحة يستمر النظام السوري
بدون رادع باستهداف المدنيين عمداً، واستخدام صنوف متنوعة من الأسلحة المحرمة
بما في ذلك الأسحلة المحرقة، كما تم توثيق ذلك في داريا بتاريخ 11/8/2015. يقوم
النظام بفعل ذلك، لأنه يشعر بأنه على الرغم من هذا التحرك المتواضع للمجتمع
الدولي، فإنه سيفلت في كل حال من العقاب. يجب على هذه الحالة من الإفلات من
العقاب أن تتوقف. يجب على المجتمع الدولي أن يرسل رسالة واضحة بإحداث آليات
محاسبة فعالة وذات مصداقية لمحاكمة ومعاقبة كافة مرتكبي جرائم الحرب والجرائم
ضد الانسانية في سوريا.
